The legal saga between Travellers camped in Shurlock Road and the Royal Borough continues to drag on.
The High Court decided today to grant occupants of the unauthorised site permission for a judicial review of the council's decision to take direct action and remove them from the land.
It refused a separate review application over the borough's refusal to determine a planning application in February.
Cllr MJ Saunders, cabinet member for planning and property, said: "We are of course disappointed
"We will continue our efforts to clear this grassland and restore it to its original condition."
No date has been set for the judicial review.
The council wants the 40-plus occupants to quit Five Oaks Farm or be forced off.
Ten families set up home in Shurlock Road three years ago.
